Welcome to HeartInCare ("we," "us," or "our"). This User Agreement ("Agreement") governs your access to and use of our platform, including our website (https://www.heartincare.com), Android app, and iOS app (collectively, the "Services"). By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree to these terms, please do not use our Services.
HeartInCare is operated by İNVİCTUS TURİZM KONGRE VE ORGANİZASYON HİZMETLERİ LİMİTED ŞİRKETİ, a limited liability company registered in Turkey, with its registered office located at Halaskargazi Cad. Teyyareci Cemal Sk. No:3 D:1 34360 Şişli/İstanbul.
By using our Services, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into this Agreement. Our Services are not intended for individuals under the age of 16.
To access certain features, you may need to create an account by providing accurate, current, and complete information as prompted by the registration process.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Our Services are provided solely for your personal, non-commercial use.
The app collects health data such as heart rate, blood pressure, ECG measurements, steps, sleep patterns, stress levels, and SpO2 levels.
Data collected by and stored in HealthKit or similar services is for reference and informational purposes only and should not be used for medical diagnosis or treatment.
You agree to comply with all applicable local, state, national, and international laws and regulations while using our Services.
HeartInCare reserves the right to terminate or suspend your account, without prior notice or liability, if you violate the terms of this User Agreement or engage in activities that may harm the application, its users, or third parties.
This termination provision is in place to ensure the safety, security, and integrity of the HeartInCare community.
You agree to provide accurate and up-to-date information during the registration process and throughout your use of HeartInCare. This ensures that all services provided to you are based on correct and current data.
You are largely responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect any unauthorized access. We are committed to working with you to protect your account integrity.
You agree not to misuse our Services. Prohibited activities include, but are not limited to:
You are solely responsible for any content that you upload, post, or transmit through the Services.
All content, features, and functionality of the Services (including but not limited to software, text, graphics, and logos) are the exclusive property of HeartInCare and are protected by international copyright, trademark, and other intellectual property laws.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services.
Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using our Services, you consent to the practices described in the Privacy Policy.
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time without prior notice.
You may terminate this Agreement at any time by deleting your account and ceasing all use of the Services.
We may suspend or terminate your access to the Services immediately if you violate any terms of this Agreement.
The Services are provided on an "as is" and "as available" basis, without any warranties of any kind.
The information provided by the Services is strictly for general informational and reference purposes only and should not be considered medical advice, diagnosis, or treatment.
We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
You agree to indemnify, defend, and hold harmless HeartInCare, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Agreement or your use of the Services.
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, this Agreement shall be instituted exclusively in the courts of Istanbul, Turkey.
We may revise and update this Agreement from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Agreement means that you accept and agree to the changes.
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions of this Agreement will remain in full force and effect.
This Agreement, together with our Privacy Policy, constitutes the sole and entire agreement between you and HeartInCare regarding the Services.
Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights.
